EQUIPMENT RENTAL TERMS AND CONDITIONS (ONTARIO)
1. Rental Items Covered
This agreement applies to all rented inventory, including but not limited to tents, temporary structures, tables, chairs, string lighting, and electrical accessories.
2. Condition of Equipment and Handover
The rental company delivers and installs all equipment in good, safe, and operational condition. The customer (or their property representative) accepts the equipment "as is" immediately upon completion of installation. Any defects must be reported to the installation crew prior to their departure.
3. Complete Custody and Risk of Loss
Upon completion of delivery and installation, absolute custody and control of the equipment transfer entirely to the customer. The customer assumes all financial risk for loss, theft, vandalism, weather-related damage, or physical damage to the equipment from any cause whatsoever while it remains on the customer's or host's property. The customer agrees to pay the full market replacement or repair cost for any equipment compromised post-installation.
4. Property and Surface Damage Waiver
The rental company is not responsible or liable for any damage to the customer's property, including but not limited to: dead or indented grass, damaged asphalt/paving stones, or punctured underground utilities (irrigation, gas, or electrical lines). It is the customer's sole responsibility to mark underground hazards before installation.
5. Comprehensive Personal Injury Waiver
THE CUSTOMER EXPLICITLY WAIVES, RELEASES, AND HOLDS HARMLESS THE RENTAL COMPANY FROM ANY AND ALL LIABILITY FOR PROPERTY DAMAGE OR PERSONAL INJURIES (INCLUDING BODILY INJURY, ILLNESS, OR DEATH) ARISING FROM THE USE, PRESENCE, PLACEMENT, OR FAILURE OF THE RENTED TENTS, LIGHTS, TABLES, OR CHAIRS. The customer accepts all risks associated with hosting an event utilizing this commercial equipment and agrees to insulate the rental company from third-party guest claims.
6. Governing Law
This agreement is governed by and construed in accordance with the laws of the Province of Ontario, Canada.
